ji ye hadis imaam-e-saadiq ( عليه السلام ) se marwi hai , hadis ki asl aebaarat is tarah hai :
اِذَا جَاهَرَ الفَاسِقُ بِفِسقِهِ فَلَا حُرمَةَ لَهُ وَلَا غِيبَةَ
وسائل الشيعه ج 12 ص 289 باب 154 باب المواضع التى تجوز فيها الغيبة ح 4 / امالى شيخ صدوق ص 39
jab faasiq ( koei shakhs ) khullam khulla ( کھلم کھلا ) alaaniya apne fisq wa gunaah ka irtekaab kare to ous ke liae hurmat wa eiz'zat nahi hai our ghibat nahi hai
( yaani wo qaabil-e-aehteraam nahi hai our ous ki ghibat jaa'aez hai )
Hadis ki mokhtasar wazaahat :
(1) jo sab ke saamne gunaah karta hai ouse koei sharm wa haya nahi lehaaza ous ka aehteraam na karen
aehteraam na karne our tahqir wa tauhin karne me farq hai
tahqir wa tauhin karna sahih nahi hai is liae ke ye maasumin ( سلام الله عليهم ) ki sirat ke khelaaf hai
jo alaaniya gunaah kar raha hai wo khud apni hurmat wa eiz'zat ko paa'maal wa naabud kar raha hai jis ko khud apni eiz'zat wa aehteraam ka khayaal nahi to dusre keyon karen ?
dusre ye ke agar aehteraam karen ge to gunaah'gaar ki hausla afzaaei hogi
(2) alaaniya gunaah karne wale ki ghibat karne ke mota'alliq foqaha ki 2 nazar hai :
1. baaz farmaate hain ye kaam ghibat hai lekin haraam nahi hai yaani ghibat karna jaaez hai
2. baaz farmaate hain ye kaam na ghibat hai our na hi haraam
(3) aehteraam na karna our ghibat karna kab jaaez hai ?
is rewayat me aek mohim shart ka zikr hai wo ye hai ke " alaaniya gunaah kare "
lehaaza jo alaaniya gunah nahi karta hai to ous ka aehteraam karen our ous ki ghibat jaaez nahi hai , ba alfaaz-e-digar alaaniya gunaah karne waale ki tashkhis kaise karen ? meyaar ourf ki nazar hai
is ta'alluq se chand dusri baaton ki taraf aeshaara karna zaruri hai :
1. agar koiy sirf apne doston ke darmeyaan ya ghar ke andar gunaah kar raha hai sab ke saamne nahi kar raha hai to is ka shumaar alaaniya gunaah karne walon me nahi hoga lehaza aiysa shakhs mohtaram hai our is ki ghibat jaaez nahi hai .
2. agar koiy apne shahar ya watan me alaaniya gunaah kar raha hai to yahan ous ka aehteraam na karen our ghibat jaaez hai
lekin dusre shahar me aiysa nahi kar raha hai to is shahar walon ke liye ous ki ghibat jaaez nahi hai
3. agar wo is gunaah se tauba karle to ous ka shumaar alaaniya gunaah karne waalon me nahi hoga lehaaza ous ka aehteraam karen our ghibat na karen.
taa hayaat ous ka shumaar alaaniya gunaah karne walon me nahi hoga
(4) jo alaaniya gunaah karta hai ous ki ghibat sirf ousi gunaah ke ta'alluq se kar sakte hain jis ko alaaniya anjaam de raha hai
misaal :
agar koiy mard alaaniya sharaab pi raha hai ya juaa (جوا) khel raha hai ya koiy khaatoon be parda baazaaron ... me tahalti hain koiy parwa nahi to sirf sharaab , juaa our be pardagi ke mota'alliq hi ghibat kar sakte hain .
dusre poshidah gunaah ke baare me ghibat nahi kar sakte hain
(5) aehteraam na karne our ghibat karne ki hikmat wa maqsad :
momin ki be aehteraami our ghibat karna haraam hai , gunahe kabira hai lekin maasumin (سلام الله علیهم) se marwi rewayaat ke motaabiq kuch mauqe aiyse Aate hain ke aehteraam karna zaruri nahi hai our ghibat karna hi behtar hai balke basa auqaat zaruri ho jaata hai .
keyon ke is me makhluqe khoda ki maslehat our moaashere ki islaah poshida hoti hai lehaaza deen ne kuch makhsus jaghon par aehteraam na karne wa ghibat karne ki aejaazat di hai
albatta aehteraam na karna our ghibat karna tauhin , tahqir , chota dekhane our inteqaam ke taur par na ho balke maqsad ous shakhs ki islaah wa najaat our gunaah se bachaana ho.
