dokhul ke pahle ada karna zaruri nahi hai lekin agar aqde nikaah me indalmotaaleba (عند المطالبه) wa indalistetaa'at (عندالاستطاعة) ki shart nahi hai to aqd ka segha jaari hone ke baad our nazdiki ke pahle bivi tamaam mahar ko talab karne ka haq rkhti hai ye bivi ka maali haq hai lehaaza ada karna shawhar par waajib hai.  jabtak ada nahi karega bivi ka qarzdaar rahega.

qarz jetni jaldi ada kiya jaaye behtar hai magar ye ke bivi ko raazi karle ya khud bakhsh de

*1) indalmotaaleba :*

yani jab bivi mahar mange to ous waqt ada kiya jaae

*2) indalistetaa'at :*

yani maali lehaaz se mahar dene ki qudrat wa salaahiyat hojaae tab ada karega

*(dono sharton ke hawaale se bahas tafsili hai)*

*3)* (khoda na kare) agar dokhul ke pahle talaaq de to moqar'rar shudah mahar ka aadha awrat ko dena mard ke zim'me hai lekin dokhul ke baad mokam'mal hai

*daaemi aqde nikaah me mahar rukn ( رکن ) nahi hai lehaaza agar mahar tay (معین) na karen ya ada karne ka qasd wa aeraada na ho tab bhi aqd sahi hai baatil nahi hai*

ada na karne ki sirf niyat shr'an gunaah nahi hai  masalan qarzdaar qarz na dene ki niyat kare ya chor chori ki niyat kare to  ye ous waqt tak gunaah nahi hai jabtak amali jaama na pahnaae
*albatta baateni khabaasat wa sharaarat zrur hai*
