Maahe Rajab me subh-o-shaam padhi jaane waali doa ki fazilat | daadhi pakadne | oungli harkat dene ka tariqa | is ki hikmat Maahe Rajab me "Daa'ei" farishta kis ko aawaaz deta hai aur keya kahta hai ?

Salamun Alaikum.
Sawal :-

kya "Ijtihaad" aur "Qayaas" ek he cheez hai? Deen me Qayaas lagana(qayaas se kaam lena) haram hai?

*mokhtasar jawab :*

ijtehaad aur qeyaas  eak hi chiz nahi hain balke dono me farq hai , ijtehaad me dalil aur burhaan ke zariye hukm akhz kiya jata hai aur qeyaas me apni ra'ae aur gumaan wa kheyaal ke zariye se hukm malum kiya jata hai

ji , deen aur ahkaam-e- aelahi  me qeyaas se kaam lena haraam hai , rewayaat me is ki bht mazammat ki gai hai

*Qadr-e- tafsili jawab :*

 ijtehaad aur qeyaas aise mouzuaat hain jis ke bare me hamare olama aur maraje keraam Najaf-e- ashraf aur Qum al moqaddasah me apne darse kharij ... me barson bahas karte hain aur is ta'alluq se badi badi ketaben bhi likhi hain , ye mouzuaat olama aur mujtahedeen se marbut hain lehaza aam momenin-e- gerami ke liye chand line me is ke baare me bayan karna bht mushkil wa sakht hai , bahar haal mokhtasar jawab molaheza farmaen :

*Ijtehaad ki tarif :*

makhsus sharaet wa o'sul o qawanin ke motabiq motabar dalilon se oun ahkaam-e- shar'ei ko malum wa akhz karna jo nahi malum hai

is me mujtahedeen ki zaati ra'ae wa kheyaal ki modakhelat nahi hoti hai

asre hazir ke jadid masael me ijtehaad ki ashad zarurat hai

*qeyaas ki tarif :*

kisi chiz ka hukm malum hai aur kisi dusri chiz ka hukm nahi malum hai , malum aur na malum chiz me moshabehat ki bena par qeyaas kar ke kahen na malum chiz ka bhi wahi hukm hai jo malum chiz ka hai , masalan malum hai ke ye kala angur mitha hai aur kisi dusri kali chiz ke bare me nahi malum ke mithi hai ya nahi , angur aur is chiz me moshabehat kala hona hai lehaza kahen kala angur mitha hai lehaza ye kali chiz bhi mithi hai , jabke har kali chiz mithi nahi hoti hai
