*fiqhi mesaal :*
malum hai ke zena se bada gunaah , qatl hai , dono me moshabehat gunah hai , gunaah ke lehaz se dono mushtarak hain , zena ke liye malum hai ke is me 4 gawahon ki zarurat hai lekin qatl ke bare me nahi malum ke is me ketne gawahon ki zarurat hai lehaza dono me gunaah jaisi moshabehat ki bena par aur bada gunaah hone ki wajah se qeyaas kar ke kahen qatl me bhi 4 ya is se zeyadah gawahon ki zarurat hai
agar qeyaas par amal karen to isi tarah amal karna hoga jabke aisa nahi hai , qatl me sirf 2 gawah kafi hain
imam-e- Baqir (a.s) aur imam-e- Sadiq (a.s) ke shagird abu hanifah sb qeyaas karne me bht mahir the , aasmaan se zamin tak qeyaas karte the , in ka eak waqea ye hai ke :
eak din ye na'ei ki dokaan (hairbresser) gae , darhi (داڑھی) ke kuch baal safed ho gae the , na'ei se kaha safed baal ko nikaldo take dobara safed baal na niklen , to na'ei ne kaha safed balon ki khasiyat ye hai ke ise jetna nikalen ge ous se zeyadah nikalte hain , to kaha kale balon ko nikaal do
ye qeyaas hai , agar ye baat sahih hai ke safed baal nikale jaen to zeyadah nikalte hai phir kale balon ko nikaaldo ta ke kaale baal zeyadah niklen
agar is tarah ki baat wa qaedah sahih hai to sirf safed balon ke ta'alluq se sahih hai , kale balon par ye qaedah jari nahi hoga
ye sahab deen wa ahkaam-e- aelahi me bhi isi tarah qeyaas karte the , deen wa ahkaame aelahi me qeyaas se elm o yaqin hasil nahi hota balke gumaan wa kheyaal hota hai aur zanno gumaan deen me mana hai , qeyaas , elm o yaqin aur deen se dur karta hai , deen ko nabud karta hai isi liye masumin (علیهم السلام) ne is ki bht mazammat ki hai
imam-e- Sadia (a.s) ne apne pedar se aur inhone apne jad se naql kiya hai ke rasul-e- khoda ne farmaya (naql-e- mafhum) : sabse pahle jis shakhs ne deen me apne qeyaas wa ra'ae se kaam liya wo iblis tha
iblis ne hukm-e- aelahi ke moqabele kaha : mujh ko tu ne aag se payda kiya hai aur aadam ko mitti se , lehaza me aadam se behtar hun
sheytaan qeyaas hi ki wajah se gumraah hua
ye rewayat bhi imam-e- Sadiq (a.s) se naql hui hai : " jo dini omur me apne qeyaas aur ra'ei se kaam le to khodawande aalam roze qeyamat ous ko iblis ka ham nashin qarar dega
lehaza khoda se darna chahiye aur deen ke moamelaat me apni ra'ei aur qeyaas ko dakhal na den
khoda na kare agar is waqt koiy shia deeni omur me apne qeyaas aur ra'ei se kaam le to aisa shia maulaaiy nahi balke iblis aur abu hanifah ka wakil hai

*1-* eak qeyaas hai jis par olama aur shia mujtahedeen ne amal kiya hai , dar haqiqat ye qeyaas nahi hai bas iska naam qeyaas hai , ye qeyaas manteqi aur dalil o burhaan ke sath hai is me zaati ra'ei aur gumaan wa kheyaal ka dakhal nahi hota , is qeyaas ko mansusul eillat (منصوص العلة) kahte hain masalan kaha gaya ke sharaab haraam hai , is liye ke nashah aawar hai , is se samajh me aata hai ke nabiz (khurma , angur ... se bani sharaab ) mast karne wali hai lehaza ye bhi haraam hai , aap khud molaheza farmaen janabe abu hanifah ke qeyaas aur is me kitna farq hai (tafsil , mantiq aur osule fiqh ki ketabon me hai)
*2-* misalen sirf samjhane ke liye di gai hain , misalon me monaqashah wa neza nahi hoti
*3-* qeyaas ke hawale se imam-e- Baqir (a.s) aur imam-e- Sadiq (a.s) ne abu hanifah sb ka imtehaan liya hai , is ka zikr tarikhi ketabon me hai is ko zarur padhen
imamon aur abu hanifah ke darmeyaan jo baat huiy ous ko mowarrekheen monazarah likhte hain , ye monazarah nahi tha balke imamon ne hazrat ka imtehaan liya tha jis me fail hogai
